Jair Bolsonaro has been taken into custody after authorities concluded he posed a definite escape threat while under domestic detention.

The ex-president was convicted of orchestrating a government overthrow in September and sentenced more than a 27-year term in incarceration, but he remained under house arrest pending court reviews.

Top Judicial Official Justice Moraes said the action to imprison the elderly politician was a preventative measure after "new facts" emerged.

This involved seeking to disable his tracking device and a call for a demonstration that could enable a potential flight.

Court Filing Details Flight Fears

In a filing authorising the detention, the judge said data from the facility tracking the former president's confinement suggested the ex-president's "intention to break the surveillance device to guarantee victory in his flight.

This, it said, would be assisted by the chaos caused by the demonstration called by his son.

His son, his son Flávio, who works as a legislator, called for a meeting of his backers near Bolsonaro's home to take place on the weekend.

Flávio Bolsonaro wrote on online platforms on last Friday: "Are you going to fight for your homeland, or see it all from your mobile device there on your settee? I call on you to struggle with us."

He said the vigil would be so backers could seek divine intervention for his well-being and for the restoration of democratic rule in our land."

Embassy Asylum Concerns

Bolsonaro is being held in a national police facility in Brazil's capital city and will experience a custody hearing on the next day.

Recent Legal Requests

It was only on the previous day that the his legal team asked the Supreme Court to authorize him to complete his entire prison term under home confinement, with tracking devices.

They also petitioned that he be permitted to leave his home for healthcare, saying he demanded regular treatment for lung conditions and other illnesses.

Context of Sentencing

He was convicted of orchestrating a conspiracy aimed at keeping him in power after he lost the presidential race to his political opponent, President Lula.

Supreme Court justices said that he had knowledge of a plot which included plans to assassinate his opponent and his vice-presidential running mate, his vice-presidential candidate, and to imprison and murder Alexandre de Moraes - the Supreme Court justice who has been presiding over the former president's case.

The plot was stopped because it didn't receive the endorsement of the army and air force commanders. His successor was sworn in without issue on 1 January 2023.

But a following week, on January 8th, numerous his followers stormed and vandalised government buildings in the capital, Brasília.

The law enforcement stepped in and around approximately 1,500 persons were taken into custody.

The judges found that the rioters had been provoked by him whose plan, they said, was for the national armed forces to take action, restore order and bring him back to power.

At the period, Bolsonaro's lawyers called the 27 years and three months sentence extremely harsh.

He was also barred from campaigning for office until the year 2060 - a decade minus two years after the completion of his term.

The ex-leader called the court case a political persecution and said it was intended to stop him participating in the next presidential race.
